Planning a Custom Garage: Permits, Setbacks, HOAs & Site Feasibility
Before choosing a floor plan or ordering a building, find out what the property can legally and practically support. This guide explains the early questions that shape detached garages, RV garages, workshops, steel buildings, and garage-plus-casita projects across Phoenix’s Northwest Valley.
Step one
Identify Which City or County Reviews the Property
A Phoenix mailing address does not always mean the City of Phoenix is the permitting authority. The parcel may be within Phoenix, another incorporated city, or unincorporated Maricopa County. The approving authority controls the applicable zoning, building-code amendments, submittal process, fees, and inspections.
Start with the exact project address and parcel information. Confirm the jurisdiction before relying on a general search result, a neighbor’s experience, or a plan marketed as “Arizona ready.”
Incorporated Property
The applicable city—such as Phoenix, Peoria, Surprise, or Buckeye—generally manages zoning review, building permits, and inspections.
Unincorporated Property
Maricopa County Planning & Development generally manages the review, subject to county zoning, building, drainage, floodplain, and site requirements.
Do not assume a garage is permit-exempt
Most Custom Garages Require a Building Permit
The City of Phoenix lists all new detached residential structures larger than 200 square feet among the projects that require permits. Electrical work, plumbing additions, gas modifications, and similar improvements may require additional review or permits. A typical one-, two-, multi-car, RV, workshop, or garage-plus-casita project will exceed the small-structure exemption.

Permit exemptions are narrow and do not necessarily waive zoning, setback, drainage, utility, HOA, or private-covenant requirements. A structure that is exempt from one type of permit is not automatically allowed anywhere on the lot.
The lot sets the boundaries for the design
Review Setbacks, Lot Coverage, Easements, Height & Fire Separation
A garage footprint must fit within the buildable area of the property. The apparent open space in a backyard or side yard can be reduced by setbacks, utility or access easements, drainage facilities, washes, floodplain conditions, septic components, private restrictions, or lot-coverage limits.
Setbacks
Required distance from property lines, streets, alleys, and other structures can vary by zoning district, building size, height, use, and jurisdiction.
Lot & Yard Coverage
The main home, patios, garages, sheds, and other covered improvements may count toward limits. The method of calculation depends on local rules.
Easements
Utility, drainage, access, and other recorded easements may restrict foundations and permanent construction even when the area appears unused.
Height
RV bays, second-story living space, roof pitch, parapets, and mechanical equipment can make height a defining feasibility issue.
Fire Separation
Walls, openings, eaves, and construction assemblies near property lines or other buildings may require special design.
Drainage & Floodplain
A new foundation and driveway change how water moves across a site. Grading, retention, washes, and floodplain review can affect placement and cost.
Unincorporated Maricopa County Example
As of this review, Maricopa County’s residential FAQ states that detached accessory buildings other than ADUs may be placed at least three feet from certain side or rear lot lines, subject to yard-coverage and other rules. A separate county directive notes that walls or columns less than five feet from a property line may require one-hour fire-rated construction. These are not universal Phoenix-metro rules and should not be applied to a city property.

A bay is only useful if the vehicle can reach it
Confirm Driveway Access, Turning Radius & Door Approach
Large garages often fail on paper because the design focuses on the building footprint while ignoring the path to the door. RVs, boats, trailers, and long trucks need room to turn, straighten, clear gates, and approach without bottoming out.
Evaluate access before locking in the building position. Moving a garage several feet, changing the door wall, widening an approach, or adjusting the pad elevation can make the difference between a usable building and a daily struggle.
- Street width and direction of approach
- Driveway width, slope, turning path, and surface
- Gate openings, walls, columns, landscaping, and utilities
- Space in front of the door to straighten the vehicle
- Vehicle wheelbase, rear swing, hitch, mirrors, and trailer articulation
- Drainage transitions and vertical clearance
- Fire apparatus or emergency access where applicable
Plan Utilities Before the Foundation and Floor Plan Are Final
Utility needs can affect both feasibility and cost. A detached garage may require trenching, panel upgrades, water or sewer routing, septic review, gas coordination, or equipment space. A garage with a casita has additional residential, energy, ventilation, and life-safety requirements.
Electrical
General outlets, lighting, garage doors, RV service, EV charging, tools, lifts, welding equipment, HVAC, and future loads should be coordinated with available capacity.
Plumbing
A utility sink, restroom, shower, laundry, kitchen, water heater, or RV connection may require significant routing and approval decisions.
HVAC & Ventilation
Workshops and living space require a plan for Arizona heat, insulation, air sealing, fresh air, exhaust, and separation from vehicle or work-area contaminants.

An HOA Approval Is Not the Same as a Building Permit
A city or county reviews public zoning and building requirements. An HOA applies private covenants and architectural standards. Approval from one does not guarantee approval from the other.
HOA documents may address detached structures, height, roof pitch, exterior materials, colors, garage-door visibility, driveway changes, RV storage, windows, privacy, construction hours, and submittal procedures. Obtain the current architectural guidelines early and include the review schedule in the project plan.
Practical rule: Do not assume that a city’s expanded allowance for an ADU or accessory building overrides a private covenant. Have the relevant documents reviewed for the property.

The exact submittal varies, but custom garages often require some combination of the following. Complex sites, engineered structures, RV-height walls, steel buildings, habitable space, grading, floodplain, or septic conditions can add requirements.

Why Garage Permit and Construction Timelines Vary
A simple detached garage on a straightforward lot will not follow the same schedule as an RV-height steel building, a second-story garage apartment, or a garage with a full casita. Avoid any universal promise until the jurisdiction and scope are known.

Garage Permit & Planning FAQs
Do I need a permit for a detached garage in Phoenix?
The City of Phoenix identifies new detached residential structures larger than 200 square feet as permit-required work. A normal vehicle garage is typically larger than that threshold. Zoning, utilities, and other requirements may also apply.
Can I put a garage three feet from my property line?
Do not apply that rule without confirming the jurisdiction and zoning. Maricopa County publishes a three-foot standard for certain detached accessory buildings in specified yard locations, but fire-rated construction may apply within five feet and city rules can be different.
Does an HOA approval replace the permit?
No. HOA approval is a private architectural review. A building permit is a public approval. A project may need both, and approval from one does not guarantee approval from the other.
Can I use pre-designed garage plans?
Pre-designed plans may be a useful starting point, but they still must fit the site, jurisdiction, structural criteria, utilities, energy requirements, and intended use. Modifications or site-specific engineering may be necessary.
Can a garage include living space?
Potentially. Habitable space introduces zoning, ADU, fire separation, egress, energy, HVAC, plumbing, accessibility, and other requirements. The property and intended use must be reviewed before the concept is treated as feasible.
Who verifies a contractor’s Arizona license?
The Arizona Registrar of Contractors provides an official contractor-search tool. Check the current license record and confirm that the classification is appropriate for the work before hiring.
